Affluent Businessman, Despite Lavish Lifestyle and Five Luxury Cars, Neglects Child Maintenance and School Fees Payments

Following their divorce in September 2018, a Pretoria man and his ex-wife entered into a settlement agreement that outlined various financial responsibilities. Among these, the man committed to paying his ex-wife R300,000 for spousal maintenance by July 31, 2018, purchasing a house valued up to R2.6 million, covering transfer costs, contributing 50% for specified furniture and household items, maintaining her Mercedes-Benz, and meeting financial obligations for their two children, including school fees and monthly maintenance.

However, in November 2022, the ex-wife took legal action, claiming arrears in child and spousal maintenance, along with other outstanding amounts. The man, acknowledging certain defaults, cited the negative impact of the Covid-19 pandemic on his business. Judge Jan Jacobus Clute Swanepoel found discrepancies in the man's testimony, deeming some evidence deceptive. The judge ordered the man to finalize the house purchase by January, settle outstanding maintenance, pay school fees in advance, and cover the costs of the legal application. The ruling aims to address the prolonged delay in fulfilling the agreed-upon obligations since the divorce five years ago.
